EEOC Files Lawsuit Alleging Violation of the Americans with Disabilities Act

A job applicant alleges that he is dyslexic. Dyslexia is generally recognized as a reading disability. The prospective employee argues that he was qualified for a job opening as a carpenter, but that a Connecticut electrical construction company and construction management/design company refused to hire him claiming that, due to his dyslexia, "he would present a safety risk." The applicant claims that he had fifteen years' experience without safety violations as a carpenter. In addition, the applicant alleges that the companies did not pursue accommodations for his disability. After settlement failed, the EEOC filed a lawsuit against the companies arguing that by refusing to hire this prospective employee, the companies violated the Americans with Disabilities Act ("ADA"). This case is a reminder that one goal of the EEOC is to protect employees against the employers who "still deny work opportunities to qualified people who are ready and able to perform the job, simply because of myths and fears about their medical impairments or disabilities."
