Age Discrimination

A large US retailer, with 10,000+ employees nationwide, settled an age discrimination lawsuit filed by the EEOC. The EEOC charged that the retailer was guilty of age discrimination when, in an effort to reduce its workforce, it fired seven managers who were over 40-years-old. The EEOC also alleged that the retailer retaliated against employees who would not follow orders to discriminate against the older employees.

The Age Discrimination in Employment Act ("ADEA") was passed in 1967 and makes it illegal for an employer to discriminate against persons aged 40 years or more in hiring, discharge, compensation, or terms of employment.

In addition to the monetary relief awarded, the retailer must train its employees on "the prevention and eradication of age discrimination" which the EEOC says continues to be an issue in the workplace. "Too many employers fail to see the value of the experienced portion of their workforce." Read the press release.
