EEOC Alleges Discrimination by FedEx Ground of Hearing Impaired Persons

Last month, the EEOC filed a lawsuit against FedEx Ground Package System, Inc. ("FedEx Ground") alleging that for years FedEx Ground had discriminated against deaf and hearing impaired employees and applicants. The lawsuit is the result of a consolidation of nineteen different charges from around the country alleging discrimination by FedEx Ground of deaf and hard-of-hearing package handlers.

The EEOC alleges that FedEx Ground violated the Americans with Disabilities Act (ADA) when it did not provide needed accommodations for employees and applicants who were hearing-impaired. Some examples include not providing closed-captioned training videos for new employees, not providing sign interpreters for mandatory meetings, and not providing vibration devices for scanning packages (FedEx Ground used scanners that were sound activated).

The EEOC argues that FedEx Ground could have provided reasonable accommodations to these disabled employees and applicants without imposing undue hardship upon itself. Read entire release.
